Image Layouts for Social Media - Terms of Use

BEFORE THE USE OF JETBLACKCODE IMAGE TOOLS (including IMAGE CROPPER, IMAGE OVERLAY, IMAGE PAIR, AND ANY OTHER IMAGE TOOL) OR ANY OTHER JETBLACKCODE SERVICE, YOU ARE REQUIRED TO READ, UNDERSTAND AND AGREE TO THESE TERMS. YOU MAY ONLY USE THE JETBLACKCODE SERVICES AFTER HAVING READ AND ACCEPTED THESE TERMS. IF YOU DO NOT AGREE TO ALL OF THE CONDITIONS SET FORTH IN THIS DOCUMENT, PLEASE REFRAIN FROM USING OUR PRODUCTS AND SERVICES.

1. Definitions

1.1 "JetBlackCode": The body responsible for creating and managing the services provided on the JetBlackCode website. (includes any part or sub-domain of "jetblackcode.com")

1.2 "JetBlackCode Service" or "Service": unless otherwise specified, "Service" in these terms means any service provided on the JetBlackCode website, including but not limited to Image Cropper, Image Overlay, Image Pair.

1.3 "User" or "you": any natural person, legal entity or legally responsible partnership who accesses the Service, with or without registration.

1.4 "Content": a collective term for any image, text, video/audio clip, music, sound, conversation, or any other file that Users upload to the Service or that is generated through the Service.

2. Content

2.1 All Content shall comply with local laws/regulations, respect third-party rights and follow commonly accepted social norms.

2.2 By using the Service, the User agrees that all Content, whether publicly posted or privately transmitted, is the sole responsibility of the person who has generated, transmitted, shared or posted the Content. This means that the User, not JetBlackCode, is entirely responsible for all Content at every stage. This includes editing, uploading, posting, sharing, emailing or otherwise transmitting or making available Content via any Service provided.

2.3 JetBlackCode does not guarantee the storage of any Content and is not intended as a back-up solution. The User should back-up all Content that he/she considers important. JetBlackCode is not responsible for any Content that is lost or damaged.

2.4 JetBlackCode, nor any person associated with JetBlackCode or acting on behalf of JetBlackCode, does not view, edit, copy, download, or share Content uploaded by User, other than that which is required to provide the functionality of the Service. Content is held in cloud-based storage to allow the processing by the Service to take place and all Content is deleted from the cloud-based storage no more than 48 hours after it is uploaded.

2.5 General Content Requirements

2.5.1 User shall not to upload any of the following to Service:

  • Content that is unlawful, abusive, obscene, pornographic, profane, harmful, threatening, harassing, vulgar, defamatory, libelous, invasive of another's privacy, or hateful racially or ethnically.
  • Content that you do not have a right to edit, upload, post, share, email or otherwise transmit or make available according to any law, or due to contractual or fiduciary relationships. This includes inside information or proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements.
  • Content that could infringe copyright or other proprietary or intellectual property rights without the explicit permission of the owner and the persons (or their parents or legal guardians, where applicable) who are shown in the content, if applicable.
  • Content that assists to generate or spread malicious rumors or fake news.
  • Any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
  • Unsolicited or unauthorized advertising, promotional materials, "spam", "pyramid schemes", or any other similar forms of solicitation.

3. The Service

3.1 JetBlackCode make no guarantee as to the working status, or availablity, of the Service. The Service is updated and changed on a regular basis and as such could be unavailable at any time and without any prior notice given to users.
